Erosion Control Issues at 1605 Hether Street, Austin, Texas

The only effective controls for this site have been for it not to rain. This site has been reported to the City 8 times: 02 May 2016, 07 May 2016, 22 May 2016, 28 Jun 2016, 27 Jul 2016, 15 Aug 2016, 05 Sep 2016, and 20 Sep 2016.

The events below are in reverse chronological order from most recent to earliest.


Event 15 - 17 Sep 2016 (erosion controls missing; dirt in street)

Erosion controls are missing and unmaintained. Sediment and dirt is in the gutter mixed with decaying straw from the straw wattles.

Event 14 - 11 Sep 2016 (unacceptable erosion controls)

This builder is using straw wattles to protect against erosion. The City’s Watershed Protection Department won’t even provide specifications in their Environmental Criteria Manual (ECM) because they say they don’t work. Quoting the City Watershed Protection Department:

"Moving on the design criteria for specific E&S controls, the ECM contains the controls that are acceptable to meet the LDC as well as installation and design guidance. Straw wattles are not listed as acceptable controls in the ECM because they do not provide robust control of the 2-year storm as required in the ECM. Instead, the ECM provides design and installation guidance for Mulch Socks. Similar to Straw Wattles in shape and purpose, Mulch Socks are larger and more robust, able to quantitatively provide on-site control of the 2-year storm erosion when installed and maintained properly. COA does not anticipate adding criteria for Straw Wattles due to their limited effectiveness."

Event 13 - 05 Sep 2016 (dirt piled in front of silt fence and erosion controls missing)

The City never required the builder to put erosion controls across the entrances. Now the builder has torn up the entrances even more with bare dirt piled up all the way to the street and on the outside of the silt fences. If it rains, considerable sediment will be transported down the street. Reported once again to the City on September 5. This site has been reported to the City at least six times and still the builder ignores the ordinances.

Event 12 - 18 Aug 2016 (erosion controls not maintained or missing)

The silt fences that were finally installed are not being maintained, and the entrances still have no erosion controls.

Event 11 - 14 Aug 2016 (erosion controls not maintained or missing)

The silt fences that were finally installed are not being maintained, and the entrances still have no erosion controls. Reported again to the City on August 15.

The silt fences that were finally installed are not being maintained, and the entrances still have no erosion controls. Reported to the City again on July 27.

Event 9 - 06 Jul 2016 (no erosion controls across entrances)

The crushed silt fence along Hether has finally been fixed and silt fences have been installed along Oxford. However, the entrances still have no erosion controls.

Event 8 - 28 Jun 2016 (erosion controls not maintained or missing)

The site still looks much like it did on April 17 and on May 22, 2016 when it was once again reported to the City. The City still has not done anything to get erosion controls installed. The section along Hether is still flattened in the middle, and the one short section of silt fence along Oxford is useless.

The site still looks much like it did on April 17 and on May 22, 2016 when it was once again reported to the City. The City still has not done anything to get erosion controls installed. The City indicated that they found no issues with this site when they visited on May 5, 2016 yet it still looks much like it did on April 17. It is not clear how the City reached the conclusion that there are no issues at this site. The erosion controls along Hether and Oxford have not been fixed. The section along Hether is flattened in the middle, and short sections of silt fence along Oxford are useless. Reported again to the City on May 22, 2016.

The previous verbal warning from the City two weeks earlier apparently did not result in compliance. The erosion controls along Hether and Oxford have not been fixed, and short section of silt fence on Oxford is in worse shape than it was on April 17. Reported to the City on May 2, 2016. The City indicated that they found no issues with this site when they visited on May 5, 2016. It is not clear what the basis of that conclusion was. Reported to the City again on May 7.

Event 1 - 17 Apr 2016 (erosion controls not maintained or missing)

This is a corner lot at the corner of Hether St and Oxford Ave. The erosion controls along Hether St are not being maintained and most of the ones along Oxford Ave are missing or unmaintained. The City had issued a verbal warning three or four days earlier, apparently to no avail.
